相信居住在英國後，都會發覺英國消費者所受到的保障非常多。對於不公平的交易，消費者可選擇換貨、拒絕接受、退貨或退款。而其實消費者使用英國信用卡會有更大的保障，其中 Section 75 of Consumer Credit Act（消費信貸法第75條）可以讓你在沒有風險的情況下，安心購物！
全英國仍有超過三分一的人是不知道這條款的存在，就讓我在今編文章教大家了解這法律條例，讓你好好運用自己的消費權利！
消費信貸法第75條
Section 75 of Consumer Credit Act 消費信貸法第75條 – 主要保障消費者在購物時出現狀況，而未能享受 或享用 商品和服務，信用卡公司和出售貨品/服務的公司，將需要共同承擔責任。所以由你從商店/網店購物並使用英國信用卡直接結帳起，消費信貸法第75條便會在交易中起生效。
什麼樣的消費適用於第75條？
你的消費必須合乎以下兩個條件：
- 商品/服務的價值在£100和£30000之間
- 使用信用卡直接支付了全部 或部分 費用
換句話說，如果購買的東西有問題、破損或沒有送達（或者沒有提供到服務），信用卡公司和零售商/公司便同樣有義務把它修好 或 解決來自產品或服務的問題。
真實例子：
2020年病毒肆虐，影響各界的服務性行業，最嚴重的是航空業，為避免國家與國家之間相互感染，所有航班都被取消，歷時超過一年。當時消費者的旅遊套票、機票等，雖然可以改期或退票，但不少消費者退票時面對以credit（消費額）的形式退回，這筆錢如同被零售商扣起，對消費極沒保障（說不定哪天倒閉！）；然而，使用信用卡直接購買，當中的風險、保障和責任將由信用卡和公司承擔，因此被取消的旅遊套票、機票可獲信用卡公司全數退回。
對於近年經濟的不景氣，即使航空公司、酒店等倒閉也無需擔心，信用卡公司會為此負起責任。
間接使用信用卡 – 不適用
剛才提到，消費必須合乎兩個條件，其中第二條的『使用信用卡直接支付了全部 或部分』，這表示必須使用信用卡直接消費，整個交易過程中只有你本人（“債務人”）、信用卡發行人（“債權人”）和你的購買地點（“供應商”）之間存在的直接聯繫，通常被稱為’DCS’ link（Debtor-Creditor-Supplier）。
什麼情況是屬於間接使用信用卡？
最常見的間接使用信用卡的情況：
- PayPal
- PayPal可加入和儲存信用卡資料，以便在網上購物時使用
- 但通常PayPal使用卡，便屬於間接使用信用卡
- 這樣消費信貸法第75條在交易中將無法生效
- Visa/Mastercard Prepaid card
- 雖然這是信用卡公司推出的預付卡，但由於是屬於Debit card 的一種，而非Credit，因此將不受Consumer Credit Act保障
- 一般由銀行發出的Debit card是同樣不受Consumer Credit Act保障
建議如何使用信用卡以獲取保障？
建議大家將信用卡使用在較昂貴的產品 或 較沒有保障的服務，即使信用卡只支付部份金額/按金（deposit），只要該產品/服務的總額在£100和£30000之間，消費信貸法第75條便會即時生效，信用卡公司將有責任為你追回金額。如下：
- 酒店
- 機票
- 電腦
- 家庭電器
- 旅行套餐
