自從BNO簽證開通後，移民至英國定居的人真的越來越多。不少人藉此分享在英國生活、工作等影片，入行成為Vloggers。出了名的Vloggers 更可獲廣告商的青睞，在片段內重點推介公司、餐廳，甚至產品。Emily想透過這篇文章提醒一眾的Vloggers，英國廣告監管機構對於網上影片，曲線地植入廣告同樣有限制，大家必須留意以免踩中地雷。

必須說明影片含廣告成份
在2014年，擁有2百萬粉絲的YouTuber – Dan and Phil 的 AmazingPhil channel 中的一條影片內，沒有說明情況下曲線插入廣告，為Oreo餅乾推廣，因而被英國廣告監管機構（ASA）禁止影片繼續播放並即時下架，這事件的發生才被公眾關注到這條規例。
ASA指，Vloggers在獲得報酬的情況下沒有清晰告知粉絲，他們所觀看的影片內含有推廣產品（或服務）內容，即屬違法，違規影片將被要求更改或直接刪除，再犯者最嚴重可被實施制裁。所以 Vloggers收了錢為某產品或服務進行推廣時，有責任在影片內清楚標明內容是有廣告成份，這條規例將適用於所有類型的媒體，包括線上和社交媒體。

如何界定影片是否屬於廣告？
根據Blandy 律師事務所的文章指，要界定影片是否屬於廣告性質，可以通過以下幾點去考慮：
- 廣告商是否向 vlogger 付費？
- 這包括任何形式的報酬：貨幣、贈送物品、免費服務
- 廣告客戶對視頻有編輯控制權嗎？包括：
- 草稿內容
- 最終決策權
- 限制Vloggers為同類型的競爭對手賣廣告
假如涉及以上的事項，該影片則屬於廣告。
什麼情況下需要標明？
是否需要標註廣告，視乎情況而定。例如：
- 很明顯這就是廣告
- 例如：網紅在某品牌的線上/社交媒體平台上出現，這就很明顯網紅是為某品牌打廣告
- 上文下理的內容顯而易知，則無須標明 這是廣告
- 曲線地打廣告
- 例如：網紅在個人媒體平台上發佈影片，並以個人風格來完成影片內容
- 這種無法辯別內容是否廣告的影片，則需要標明 內含廣告成份

如何在平台上標明才算合格？
各位如要標注說明影片是廣告，則有責任在影片開始播放前告知觀眾這是『廣告』，大家可以在Thumbnails （縮略圖）和 titles （標題）內加上。如只標註在影片的 description box（內容描述框）中，因為一般觀眾無法在觀看影片前接觸到內容描述，所以是不足夠的。
