很多香港人都像emily 一樣在香港出生，但因各種原因而移居海外。因此不時要回港辦理各種證件，甚至為在海外出生的小朋友爭取香港永久居民身分。今年移民的香港人大幅增加，因此Emily 想透過發表文章，提醒各位了解和需要注意的事項。
注意事項一：國藉
根據中國國籍法，中國是不承認雙重國籍的。在『中英聯合聲明』的憲法保護下讓我們得以保留雙重國籍。但自97年回歸後，香港政府在基本法內附加多項條文，讓雙重國籍的香港人在申請各樣證件時越來越多限制。
所以當你申請任何跟中國香港有關的證件和文件時（例如：回鄉證、特區護照或申請香港永久居民身份等），你必須填寫你的國藉為『中國』。
但我的確有多於一個國籍，如何界定我的中國籍？
根據《中華人民共和國香港特別行政區基本法》第18條及附件3的規定，《中華人民共和國國籍法》的其中條文：
一. 凡具有中國血統的香港居民，本人出生在中國領土（含香港）者，以及其他符合《中華人民共和國國籍法》規定的具有中國國籍的條件者，都是中國公民。
二. 所有香港中國同胞，不論其是否持有「英國屬土公民護照」或者「英國國民（海外）護照」，都是中國公民。自1997年7月1日起，上述中國公民可繼續使用英國政府簽發的有效旅行證件去其他國家或地區旅行，但在香港特別行政區和中華人民共和國其他地區不得因持有上述英國旅行證件而享有英國的領事保護的權利。
即是只要你個人承認你本人依然是中國藉，其他護照只作旅遊用途的話，你仍然可以聲明你為中國藉。
注意事項二：香港永久居民身分不再永久
不少移民外國的港人誤以為其子女可以「無條件」擁有本港的永久居留權，但其實政府已靜悄悄地加入一些入境條款，讓海外港人跌落陷阱。
根據香港特區政府的入境處條例，非中國籍的香港特別行政區（香港特區）永久性居民會在下列情況下喪失其永久性居民身份：
『如 果 有 關 人 士 在 不 再 通 常 居 於 香 港 後 ， 有 連 續 36 個 月 或 以 上 不 在 香 港 。』便 會 喪 失 永 久 性 居 民 身 份 。
所以在海外出生的香港人子女，即使成功申請香港永久居民身分，但必須至少每3年回港一次，否則會被除去三粒星。
真實個案
以下是一些本人和身邊朋友發生過的個案，大家可以參考一下：
個案一：
這個案是我媽媽一位已移居多年的新加坡朋友。今年為了辦理轉換新身分證和回鄉證續期而回港。在辦理回鄉證填寫國藉時寫了「新加坡藉」。因此回鄉證辦事處即時拒絕她的申請。而在換取新身分證時亦同時填寫新加坡為她的國藉，現時她擔心會被除去三粒星。
個案二：
這是一件本人親身經歷的個案，3年前兒子在英國出生後，回港為他申請香港永久居民身分。在申報父母個人資料和國藉時，由於我的特區護照過了期，因此只好填寫英國護照的資料並填寫自己是英國藉。結果，入境處以我們一家不是經常居住香港為由，拒絕兒子的申請。

“喪失香港特區永久性居民身份的人士，仍可按照法例自動擁有香港特區的入境權，他/她可隨時自由進出香港特區，在香港居住、讀書或工作而不受任何限制。任何人士如想確定他/她是否已喪失香港特區永久性居民身份，可向本處居留權組申請核實其永久性居民身份證資格以及是否享有香港特區的入境權。”。

喱個每3年返香港1次的限制只用於非香港出生的香港永久居民身分人士，除非你唔係香港出世而又係外國留學3年完全冇返過香港，咁就另計。你可以睇政府網頁：https://www.immd.gov.hk/hkt/services/roa/loss.html

If baby is born after you have ILR, the baby will not have the right to get the 香港居留 3 stars. Even if baby was born before your ILR, if you apply after you have ILR it is likely the baby will not get it neither.
My 2 girls have HK ID card with 3 stars (right of abode with no condition) that was because we did their application before my wife git her ILR. I hold British passport.
