什麼是Flexiable working？
Flexiable working 是可靈活地選擇彈性上班、下班時間或在家工作的要求，以達到配合員工的需要。員工可合法地向雇主提出申請以下要求：
- 每天的工作時間
- 上班和下班時間
- 每週工作的天數
- 工作的地點
彈性上班的類型
彈性上班的工作方式可以有多種不同類型，例如：
- 分工合作
- 由二人通過分工來完成一個工作
- 遙距工作/在家工作
- 在指定的工作場所以外的地方工作，包括在家工作
- 混合工作
- 結合在指定的工作場所和家中工作
- 兼職
- 工作時間少於全職時間（通常減少工作天數）
- 壓縮工作時間
- 全職的工作時間，但工作天數較少，例如由每週5天工作改為4天（每週工作時間平均）
- 彈性工時
- 員工選擇個人的上班下班時間（在合理的工時內），但必要在核心時間範圍內，例如上午10時至下午4時
- 年化小時數
- 員工需要在一年內工作合約要求的小時數，但需要彈性工作。除了每週所需的核心時間範圍外，其餘時間將實行彈性上班。
- 錯開上班時段
- 員工的開工、放工 或 休息時間與其他員工完全不同。
- 分階段退休
- 快將到達退休年齡的員工可逐步減少工作時間，成為兼職員工。
申請的主要程序
- 員工向雇主提出書面申請
- 雇主與員工通過溝通和商討來評估方案的可行性和決定，過程必須在兩個月內完成
- 如請求被通過，雇主必須更新僱員合約內容的條款
- 如請求被否決，雇主必須提供合理的商業理由來拒絕申請。僱員可能在請求被否決後，向就業法庭上訴。
法定申請的書面內容
員工需要向雇主提出書面的”法定申請”，內容必須包括：
- 請求的日期
- 聲明彈性工作的需求
- 如何彈性工作，何時開始的詳細資料和請求
- 聲明內可能說明過去曾提出申請的細節（何時曾提出申請、申請內容）
僱主拒絕原因
僱主在拒絕員工的申請前，必須好好商討可行性。官方指引舉出各個合理的拒絕理由，以便他們拿捏商討的方向得宜：
- 增加了損害業務的額外成本
- 其他員工無法接手
- 無法招聘員工來接手工作
- 彈性工作會影響質量
- 彈性工作影響工作表現/業績
- 企業將無法滿足客戶的需求
- 提出的工作時間內是缺乏可做的工作
- 企業正計劃對職工進行調整
